1. Controller and scope of this policy
The controller for the processing of personal data on this website is Fortequa GmbH, Stahlstr. 19, 81247 Munich, Germany. Email for privacy enquiries: [Add address]. [Add data protection officer contact details, if one has been appointed.]
Updated: 27 October 2026. This policy describes the current website preview. The contact and newsletter forms are not connected to a delivery service. [Complete hosting, contractual, retention and transfer information before publication.]
2. Website access and hosting
When you access a website, technically necessary connection data is transmitted to the servers involved, including your IP address, time of access, requested address and browser information. This enables website delivery and secure operation. The legal basis is Article 6 (1) (f) GDPR; the legitimate interest is to provide and secure this website.
Technical delivery is intended to use Vercel. [Confirm and add the full contracting entity and address, hosting and security features actually enabled, recipients or processors, processing locations, server-log data and retention periods, and the data processing agreement.]
[Add any transfers outside the European Economic Area, including countries, recipients, legal basis under Articles 44 et seq. GDPR and any safeguards and how to obtain them; do not promise processing exclusively in Germany or the EU without verification.]
3. Investor confirmation and cookies
If you confirm the entry notice, this website stores the first-party cookie fortequa_professional_access with the value v1 in your browser for 30 days. It remembers only your confirmation so that the entry notice does not need to be shown again during that period. The cookie contains neither your name nor contact details. The gate function does not create a separate visitor profile or itself store an IP address. The technically necessary transmission of connection data when accessing the website remains unaffected.
This storage is used to provide the restricted content you expressly request, on the basis of Section 25 (2) no. 2 TDDDG. Insofar as personal data is processed, the legal basis is Article 6 (1) (f) GDPR. Our legitimate interest is to implement and remember the access restriction. [Have compliance confirm necessity and duration before publication.]
You can reset your investor confirmation under Cookie settings. You can also delete or block cookies in your browser. If the access cookie cannot be saved, access to restricted content remains blocked. Please allow first-party cookies and try again. Public legal pages remain accessible.
The current preview does not set optional cookies or local storage for statistics, marketing or additional convenience features. Consent to such services is therefore not required.
4. Contact and newsletter forms in the preview
The contact form creates a draft only in your browser. This form does not transmit your entries to Fortequa or a form service and does not place them in persistent website storage. If you choose to copy the enquiry, the draft is copied to your device’s clipboard at your request. You decide whether to send it later using another program.
The newsletter form only validates your entry locally. It does not transmit your email address, create a subscription or send a confirmation or marketing email. There is no newsletter tracking.
If you separately contact Fortequa by email or telephone, we process the contact information and content you provide to handle your enquiry. The legal basis is Article 6 (1) (b) GDPR for enquiries connected to a contract or pre-contractual steps with you; for other enquiries it is Article 6 (1) (f) GDPR, with the legitimate interest of responding to business enquiries. [Add email and communications providers, recipients, retention periods or deletion criteria, and any third-country transfers.]
5. Integrated services and external links
The current preview does not load web analytics, external fonts, maps, videos or social media widgets. Typography and styling are provided without external font services. Merely displaying a link to another website does not establish a connection to that provider. When you open an external link, the provider’s own information applies to data processing on that website.
[Before activating further services, add their providers, purposes, legal bases, data types, recipients, retention periods and transfers to this policy and, where necessary, consent management. Services requiring consent must load only after valid consent has been given.]
6. Data in connection with investment services
BN & Partners Capital AG may act as an independent controller for processing in connection with investment advice or investment brokerage. Details of the relevant services, responsibilities and processing are provided in the separate client documentation and the BN & Partners Capital AG privacy information. [Confirm responsibilities and data flows between Fortequa and BN & Partners before publication.]
7. Your data protection rights
Subject to the statutory conditions, you have rights of access to your personal data (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18) and data portability (Article 20). You may withdraw consent at any time with effect for the future; this does not affect the lawfulness of processing before withdrawal.
To exercise your rights, use the contact details above. You may also lodge a complaint with a data protection supervisory authority, particularly in your habitual place of residence, place of work or the place of a suspected infringement (Article 77 GDPR). The authority responsible for private businesses based in Bavaria is the Bavarian State Office for Data Protection Supervision.
8. Right to object
If we process personal data on the basis of Article 6 (1) (f) GDPR, you may object at any time on grounds relating to your particular situation. We will then stop processing the relevant data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims. You may object to processing for direct marketing at any time without giving reasons.
